Brightflag Website Terms of Use

Welcome to Brightflag (“we” “our”, or “us”). These Website Terms of Use (“Terms”) govern your use of our public facing corporate website https://www.brightflag.com (the “Site”). By accessing or using the Site, you agree to comply with these Terms.

1) Introduction

The Site provides information about the Brightflag SaaS application(the “Platform”), services provided by Brightflag to our customers (the “Services”), marketing, information, blogs, and other related content. These Terms govern your use of the Site only. The Services we provide through the Platform are governed by separate software subscription agreements entered into with our customers.

Your use of the Site is also governed by our Privacy Notice, which outlines how we collect, use and protect your personal data. For information on how we use cookies and similar tracking technologies on the Site, please refer to the Cookies Policy. When you visit the Site, you will be prompted to accept or manage your cookie preferences through a cookies banner.

2) Access and Use of the Site

2.1) Access to the Site

We aim to keep the Site available at all times but do not guarantee uninterrupted access. We may restrict or suspend access for maintenance, security, or other operational reasons.

2.2) Permitted Uses

You may use the Site for:

  • Browsing and accessing publicly available content.
  • Contacting us for inquiries or support.
  • Using interactive features in compliance with these Terms.

  • You must notify Brightflag immediately of any unauthorized use of your account.
  • Brightflag is not responsible for any loss or damage resulting from your failure to protect your login credentials.

4) Security Testing and Site Hosting

Please note that the Site is hosted by a third-party provider and is intended solely for the use of non-production data. While we make every effort to ensure the Site is secure and protected from unauthorised access, you may not conduct any unauthorized security testing, including but not limited to penetration testing, vulnerability scanning, or other forms of security assessment on the Site or its underlying infrastructure. Any such activity requires written consent from us. Unauthorized testing may result in the suspension of access to the Site and potential legal action.

5) Changes to the Site and Terms

We may modify, update, or discontinue any part of the Site at any time without prior notice. We may also update these Terms periodically. Continued use of the Site after changes means you accept the revised Terms.

6) Service Suspension and Termination

We may suspend or terminate your access to the Site at our sole discretion, with or without prior notice, if we believe you have violated these Terms or if required by law.

All content on the Site – including text, graphics, logos, and software- is owned or licensed by Brightflag and is protected by intellectual property laws. You may not copy, distribute, or modify any content without our prior written consent.

The information on the Site is provided for general informational purposes only. While we strive to provide accurate and relevant information, we do not guarantee that all content on the Site is error-free, complete or suitable for your needs.

  • You grant us a worldwide, royalty-free license to use, reproduce, and distribute it.
  • You represent that you have the legal right to share such content.
  • We may remove content that violates these Terms.

To the maximum extent permitted by law:

  • Governing Law: These Terms are governed by the laws of Ireland and the courts of Ireland shall have exclusive jurisdiction

  • No Waiver: Failure to enforce any right in respect of these Terms does not constitute a waiver of that right.
